Bloco de Esquerda reports regression in trans rights to the UN following law approval

“The legislation approved in Portugal represents a serious and unjustified regression in the protection of the fundamental rights of trans and intersex people.” This is an excerpt from a letter sent by the Bloco de Esquerda to the UN regarding the approval of a law that prohibits gender transition for minors in Portugal. DN obtained access to the document, signed by MEP Catarina Martins and Member of Parliament Fabian Figueiredo. The letter is addressed to Volker Türk, High Commissioner for Human Rights. The party members write that they consider the legislation likely to violate binding international human rights obligations of the Portuguese state. They request a public statement on the compliance of these measures with international human rights law, as well as the use of available mechanisms. Another request is for urgent communications to be sent to the Special Rapporteur on violence and discrimination based on sexual orientation and gender identity and the Special Rapporteur on the rights of children, requesting a statement on the compatibility of these measures with their respective mandates. They also ask the body to actively monitor the implementation of the approved legislation and its effects on trans and gender-diverse people in Portugal, particularly children and young people, and to establish a communication channel with the affected Portuguese civil society. Attention is also drawn to the international landscape: “In a European and global context where the rights of LGBTIQ+ people are under increasing pressure, a statement from the United Nations is essential to ensure the primacy of international human rights law in the face of political setbacks.”
